Welcome to MapYourGarden! These Terms and Conditions ("Terms") govern your access to and use of the MapYourGarden website, application, and services (collectively, the "Service"), owned and operated by KJD Digital, LLC ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Eligibility and Account Registration

Age Restriction: You must be at least 13 years of age to create an account or use MapYourGarden. By using the Service, you represent and warrant that you are 13 or older. If we discover that a user is under 13, we will immediately delete their account and associated data.

Account Information: To use certain features, you must register for an account. During registration, we collect your first name, last name, email address, zip code, and state. You agree to provide accurate, current, and complete information and to keep your account details updated. You are responsible for maintaining the confidentiality of your login credentials.

2. Free Trial, Billing, and Cancellations

Free Trial: We offer a 7-day free trial for new users to explore the Service. You may be required to provide a valid payment method to start the trial.

Billing: Unless you cancel before the end of the 7-day free trial, your account will automatically transition to a paid subscription, and your payment method will be charged. Subscriptions auto-renew automatically at the end of each billing cycle.

Cancellation: You may cancel your subscription at any time through your account settings. Please note: Billing will continue until you actively cancel your account. If you cancel, you will retain access to the Service until the end of your current paid billing period. We do not provide prorated refunds for partial months of service.

3. Acceptable Use and User Conduct

MapYourGarden is a community for garden enthusiasts. We expect all users to interact respectfully and lawfully. You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law.
• Upload, share, or store any content or images that are illegal, abusive, harassing, defamatory, pornographic, or otherwise objectionable.
• Interact negatively, harass, or bully other users within the community or through social sharing features.
• Attempt to hack, scrape, or otherwise disrupt the Service, its servers, or its security features.
• Create multiple accounts to abuse free trials or promotional offers (such as referral gamification loops).

4. Artificial Intelligence and Third-Party Tools

Google AI Integration: Our "Plant Doctor" diagnostic tool and Smart Care Sheets utilize Artificial Intelligence powered by Google AI. By using these specific features, you explicitly agree to be bound by Google's applicable Terms of Service and Acceptable Use Policies regarding AI generation.

AI Disclaimer: The Plant Doctor and AI-generated care sheets are provided for informational and entertainment purposes only. AI can make mistakes. We do not guarantee the accuracy, reliability, or completeness of any plant diagnoses, native verifications, or care instructions. Always use your best judgment before applying treatments to your garden.

5. User-Generated Content and Data Privacy

Your Content: When you use MapYourGarden, you may upload garden layouts, plant data, and photos (your "Scrapbook"). You retain ownership of your content. However, by uploading content, you grant KJD Digital, LLC a non-exclusive, royalty-free license to host, display, and process this content to provide the Service to you.

IP Logging: For security, compliance, and abuse prevention, please be aware that we collect and store your IP address when you upload images to the platform (such as snapping a photo for the Plant Doctor or adding to your Scrapbook).

Right to Remove: We reserve the absolute right, at our sole discretion, to remove any data, images, or content from the system at any time, without prior notice or liability.

6. Termination of Service

We reserve the right to suspend, disable, or terminate your account and your access to the Service at any time, for any reason, without notice or liability. This includes, but is not limited to, violations of these Terms or suspected fraudulent/illegal activity.

7. Disclaimer of Warranties

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. KJD Digital, LLC disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee that alerts (such as weather or frost warnings) will be timely or accurate.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall KJD Digital, LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (A) your use or inability to use the Service; (B) any AI-generated advice; or (C) unauthorized access to your data.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Volusia County, Florida. You hereby consent to the exclusive jurisdiction and venue of such courts.

10. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these Terms or by sending an email to the address associated with your account. Your continued use of the Service after such modifications constitutes your acceptance of the new Terms.
